    I have to tell you, I read this report in the paper when it was on the front page. While it may be true that some people are always impacted, those that have applied for Canadian PR after living in the states have been successful and had results in less than 2 years from beginning to end, and without the shadow of being employed by a given employer hanging over them.

    No, sorry. It's just not typical. The Canadian "Backlog" does not even BEGIN to compare to the broken, extended, in-status, out-of-status, this form, that form, this queue, priority date, receipt date, labor cert workflow that is the US immigration system.

    Reading this article you would think the Canadian system was a disaster. And yet, the amazing thing is, nowhere was there a mention of EXISTING problems with the US system. Just a criticism of the point system.

    Canada’s Policy on Immigrants Brings Backlog
    By CHRISTOPHER MASON and JULIA PRESTON

    TORONTO, June 26 — With an advanced degree in business management from a university in India and impeccable English, Salman Kureishy is precisely the type of foreigner that Canada’s merit-based immigration system was designed to attract.

    Yet eight years went by from the time Mr. Kureishy passed his first Canadian immigration test until he moved from India to Canada. Then he had to endure nine months of bureaucratic delays before landing a job in his field in March.

    Mr. Kureishy’s experience — and that of Canada’s immigration system — offers a cautionary tale for the United States. Mr. Kureishy came to this country under a system Canada pioneered in the 1960s that favors highly skilled foreigners, by assigning points for education and work experience and accepting those who earn high scores.

    A similar point system for the United States is proposed in the immigration bill that bounced back to life on Tuesday, when the Senate reversed a previous stand and brought the bill back to the floor. The vote did not guarantee passage of the bill, which calls for the biggest changes in immigration law in more than 20 years.

    The point system has helped Canada compete with the United States and other Western powers for highly educated workers, the most coveted immigrants in high-tech and other cutting-edge industries. But in recent years, immigration lawyers and labor market analysts say, the Canadian system has become an immovable beast, with a backlog of more than 800,000 applications and waits of four years or more.

    The system’s bias toward the educated has left some industries crying out for skilled blue-collar workers, especially in western Canada where Alberta’s busy oil fields have generated an economic boom. Studies by the Alberta government show the province could be short by as many as 100,000 workers over the next decade.

    In response, some Canadian employers are sidestepping the point system and relying instead on a program initiated in 1998 that allows provincial governments to hand-pick some immigrant workers, and on temporary foreign-worker permits.

    “The points system is so inflexible,” said Herman Van Reekum, an immigration consultant in Calgary who helps Alberta employers find workers. “We need low-skill workers and trades workers here, and those people have no hope under the points system.”

    Canada accepts about 250,000 immigrants each year, more than doubling the per-capita rate of immigration in the United States, census figures from both countries show. Nearly two-thirds of Canada’s population growth comes from immigrants, according to the 2006 census, compared with the United States, where about 43 percent of the population growth comes from immigration. Approximately half of Canada’s immigrants come through the point system.

    Under Canada’s system, 67 points on a 100-point test is a passing score. In addition to education and work experience, aspiring immigrants earn high points for their command of languages and for being between 21 and 49 years old. In the United States, the Senate bill would grant higher points for advanced education, English proficiency and skills in technology and other fields that are in demand. Lower points would be given for the family ties that have been the basic stepping stones of the American immigration system for four decades.

    Part of the backlog in Canada can be traced to a provision in the Canadian system that allows highly skilled foreigners to apply to immigrate even if they do not have a job offer. Similarly, the Senate bill would not require merit system applicants to have job offers in the United States, although it would grant additional points to those who do.

    Without an employment requirement, Canada has been deluged with applications. In testimony in May before an immigration subcommittee of the United States House of Representatives, Howard Greenberg, an immigration lawyer in Toronto, compared the Canadian system to a bathtub with an open faucet and a clogged drain. “It is not surprising that Canada’s bathtub is overflowing,” Mr. Greenberg said.

    Since applications are not screened first by employers, the government bears the burden and cost of assessing them. The system is often slow to evaluate the foreign education credentials and work experience of new immigrants and to direct them toward employers who need their skills, said Jeffrey Reitz, professor of immigration studies at the University of Toronto.

    The problem has been acute in regulated professions like medicine, where a professional organization, the Medical Council of Canada, reviews foreign credentials of new immigrants. The group has had difficulty assessing how a degree earned in China or India stacks up against a similar degree from a university in Canada or the United States. Frustrated by delays, some doctors and other highly trained immigrants take jobs outside their fields just to make ends meet.

    The sheer size of the Canadian point system, the complexity of its rules and its backlogs make it slow to adjust to shifts in the labor market, like the oil boom in Alberta.

    “I am a university professor, and I can barely figure out the points system,” said Don J. DeVoretz, an economics professor at Simon Fraser University in British Columbia who studies immigration systems. “Lawyers have books that are three feet thick explaining the system.”

    The rush to develop the oil fields in northern Alberta has attracted oil companies from around the world, unleashing a surge of construction. Contractors say that often the only thing holding them back is a shortage of qualified workers.

    Scott Burns, president of Burnco Rock Products in Calgary, a construction materials company with about 1,000 employees, said he had been able to meet his labor needs only by using temporary work permits. Mr. Burns hired 39 Filipinos for jobs in his concrete plants and plans to hire more. He said that many of the temporary workers had critically needed skills, but that they had no hope of immigrating permanently under the federal point system.

    “The system is very much broken,” Mr. Burns said.

    Mr. Kureishy, the immigrant from India, said he was drawn to Canada late in his career by its open society and what appeared to be strong interest in his professional abilities. But even though he waited eight years to immigrate, the equivalent of a doctoral degree in human resources development that he earned from Xavier Labor Relations Institute in India was not evaluated in Canada until he arrived here. During his first six months, Canadian employers had no formal comparison of his credentials to guide them.

    Eventually, Mr. Kureishy, 55, found full-time work in his field, as a program manager assisting foreign professionals at Ryerson University in Toronto. “It was a long process, but I look at myself as fairly resilient,” Mr. Kureishy said.

    He criticized Canada as providing little support to immigrants after they arrived.

    “If you advertised for professors and one comes over and is driving a taxi,” he said, “that’s a problem.”

    A genuine mistake can be corrected using nunc-pro-tunc method. I used to work for a big Indian IT major and they forgot to file my wife's H4 and when I moved to a big 4 firm..they filed nunc-pro-tunc. According to you definition, if any company makes a mistake, we are illegal. LOL.

    I can't agree more. In fact, I don't understand how we can argue the quota cap discriminate a special group. The quota cap system is very different from the case of which a man could vote but not a woman. The quota cap system applies to every country fairly. Every foreign citizen can apply for immigration. Any country reaching the cap will have to wait for next year quota. Perhaps it is *too* fair that the system doesn't account the world population distribution. IMHO I have no doubt that this case would lose in the court and I am sure that bringing this case to the court would make EB applicants enemy to the country. In the end, what do we achieve?

    Who cares if dilipcr is from BITS or some Swami PavBhaji university in Arnakulam. All are same in America. For your Greencard application you just need a minimum degree that can be acceptable by USCIS. For jobs and career, your Indian degree is nothing. It only boosts your ego and you can tell your Indian friends. If you tell your American friends they will just laugh at your ignorance. If you are so attached to your BITS then how about you go and help them be #1? It is your caliber and performance that matters in jobs. IIT and IIMs can be successful in USA or misfits same as people from third rate colleges in India. I have seen people from APTech and NIIT do better than graduates of US of top Indian colleges. So stop having a false pride. This false pride is only good for getting you married via an arranged marriage to an Indian girl in India. Nothing more than that.

    That statement was ridculously funny :D BTW, Mr Dilip, a classmate of mine from graduate school who did his Ph.d in Cryptography, couple of internships in RSA, was ranked #5 in the Math Olympiad in 1993 had to return to India because most of the jobs he applied for required security clearance, which means USC. He's now a successful head of the computer science dept. in Mumbai and the feedback from his students about his knowledge is amazing.
    Most people who came during the 1995-2001 were HTML and Cobol junkies who got lucky when their GCs were issued. Take your arguments some place else. :rolleyes:

    1) I am EB3 ROW and my PD is Nov 22, 2005. My I140 is approved and my 485 is filed with Receipt Date of Aug 3, 2007. I have approved AP, EAD and finger printing is complete as well.

    Do you know how many EB3 ROW applications are ahead of me ?
    I am trying to understand how long it will take me to get Green Card ?

    2) What is the process to ask for information related to my case using Freedom of Information Act ?

    Well, lemme give my 2 cents as I am from AP and follow politics very closely...I CAN TELL ONE THING - IF EVERYONE HAS THE SAME FACTS ABOUT SOME ISSUE, ESP. WITH ABOUT A PERSON, EVERYONE PRETTY MUCH COMES TO THE SAME CONCLUSION. So here are some of the facts, some first hand and some knowing by hailing from the area...

    I have first hand accounts about the person....There are corrupt guys and then there was YSR...to the extent most of you would not even believe!!! One of my friends was a police officer, and told me that YSR openly used to intimidate them if they did not oblige...

    It's funny someone mentioned that he had a vision, democratically elected etc., etc...My other friend comes from the same town as he, and told me how he literally 'ruled' the place with thuggery, force, intimidation, power, etc...

    Oh yeah sure he was a doctor...Did he not buy that degree through donation education from Karnataka, during good old days?

    Someone mentioned he was self made...He..Hee...He came from a well to do family, and then he made millions more through corruption, mining mafia, land grabbing, etc.

    We already have (too much) religious stuff playing politics in India. Instead of separating religion from politics, he took it up a notch...We have govt. paying the hajj pilgrims and now he was trying to have govt. pay for people who visit vatican...Sure, everybody is free to practice his/her own religion, but why should the tax payers pay for these trips?

    During the first term, it is a known fact that he allocated tons of treasury resources and govt. projects to his native area, even though other parts of the state desparately needed them...

    He sidelined other congress leaders in the state so that he would not have another voice...so much so that even though congress won many more lok sabha seats in AP than in TN, he made sure that no more than one or two MPs from AP become members of central cabinet (compared to 4 or 5 from TN congress and dmk alliance), so that he would not have a rival with power in AP. Forget about the other developmental benefits that AP could have availed by having central cabinet ministers. This is not a speculation, but following the way he ascended in politics, and the way he operates, it's not a rocket science to conclude that...

    When real estate in hyd exploded, he had his goons coming from his native place, illegally occupying the private land and govt. land alike. His brother and his goons are forcibly buying private land through intimidation. The sob even issued G.O. retroactively to pretty much legalize and take care of those forcible buyings.

    And by the way did I mention how many died since he turned politics into a sort of blood sport in Cuddaph district? People are already talking about making his son the CM. This is height of degeneration...What a pity...

    Now you might say, that's how it works in Indian politics, etc...But think about this way...

    He was a corrupt guy to the core, governs like a dictator, amasses ill-gotten wealth, eliminates rivals through intimidation and killings...In the process, none of the ordinary people did not have any betterment in their lives over the past 5 yrs. (with the exception of a few of his loyalists) and funny that the Indian new papers (or rather we should call them tabloids) are dubbing him 'Man of the people', etc.

    NOW TELL ME IF IT'S NOT A GOOD RIDDANCE, WHAT ELSE IS IT? I am not a proponent of someone dying an untimely death, but I am happy that it's a good riddance from the perspective of seeing an end to these dirty deeds, atleast from one person...I am positive everyone would atleast come to this conclusion...

    One of my friend was so frustated with this situtation , that he even explored IT jobs in gulf countries.He was telling me IBM has big presence there & with US experience , you can get manaegerial position with almost double salary.Also its nearer from India.


    Not to mention that if the offer is good and depending on the country, it is not uncommon to get a tax free salary, housing, 2 round trip tickets to one's home country for the individual and their family, in essence your major cost will likely just be food!

    I was an 'IBO' in the past. did the business for 2 years and quit. so, i am one of those "quitters" as called by up-lines and one of the many reasons why the average yearly income is only $115/year :)

    you people are fighting for two totally different reasons

    (1) is Amway business illegal for H1Bs? and is Amway business model a ponzi scheme ? been with this business, I can still stand behind the business model - its fair and simple. you just buy from one manufacturer and advertise that to others. if you notice, they are actually advertising Amway Global on national TV. Are the products worth the money you pay is a different subject. can H1Bs do this, i hear yes/no from various sources and that is a separate subject too. this thread is about the bitter experiences and not the business model itself.

    (2) Now came BWW (for those of you don't know this term, this is the reason for all your heartaches / broken friendships and bitter experiences).

    how do you advertise your product/site ?????

    when i joined the business, I have atleast 10 very good friends. I talked to all of them and asked them to understand the business model, and not worry about the advertising part. I took all of them to major conferences (they couldn't say no to me out of friendship and curiosity on what i saw in it despite horror stories) but no one was keen at that time. so, i told them to come and see me when they have some free time and are thinking about making money part-time. no hurry. thats it. no clashes between friends or bad blood. no means no. they are your friends and they will come to you when they are looking. NO HURRY.. thats me.

    this is the point where problems start. BWW talks and teaches about doing it NOW. they want us to go through as many people as possible and believe in numbers game. if you show the plan to 100 people, 1 active IBO will join. so, show the plan 3 times a week at-least. that's the motto. when they asked me to go for cold contacting i refused out-right. how can i convince a total stranger when my close friends who believe in me couldn't see it.

    most of you are crying foul of people "cold" contacting you with fake smile/friendship while they want you to join the business. but everything has to do with BWW and their methods/CDs/meetings etc. its like a competition. the sooner you grow, they grow. so, they want you to grow as fast as possible. if you have to loose your friends/relatives on the way - your up-lines don't care. they say they are your friends/family. how can that be true ??

    to Kushal: I wish you luck with your business. but you have some temper my friend. who are you fighting with ?? folks on an online forum ?? you should know better than to throw stones at someone who doesn't have a name. what are you thinking.. you think you can convince everyone here to believe Amway/quixstar is good ???? seriously ?? only if convincing is that easy ;p

    to rest of the team: I know you don't approve the advertising part by randomly meeting people. I didn't do it either and extensive damage is done. people run away from Amway/quixstar like plague because some people want to get rich quick and asked their down-lines to spread the word as fast as they can. "run through people". find 1 person willing to work at the expense of 99 people getting offended by you. word of mouth advertising works both ways. bad publicity spreads faster :)

    all I am saying is: people advertised Amway really bad. people hate amway but they should really be mad at BWW and their strategies. it is unfortunate that no one really knows or interested to know what Amway model really is. all they can think of is about horrible experiences of cold contacting and repeated chasing.

    again, i am not with this business now but still think its a good model. it is based on word of mouth advertising, franchising, residual income - everything e-commerce (which is a subject taught at some universities). now add some short sighted people to do the teaching and BINGO.. screwed it up big time.

    Good post. But tell me why should i give a damn about either Amway or BWW? I don't.

    It is horribly insane to talk to your business ambitions to a stranger. Every person is different and I personally take it offensive when someone I don't know comes and bothers me with his/her business nonsense. I am sure there are many people who think in the same way.

    In the beginning, whenever a I came across a Desi in a mall or in a public place, it used to make me happy. Now, I always suspect that it could be a Amway SOB who is coming to me with his trash bag.

    By the way, Gopi, this is nothing against you personally.

    one exception is if your spouse is a Canadian citizen or if you are working for a Canadian subsidiary (I am not sure if it has to be a governmental ).

    1) If "canadian Business" hires you "In Canada" and send you to USA for
    handling its "International Business" then also your stay in USA would be
    considered as your "Physical stay" in Canada.
    2) If you become Canadian Government Employee and it sends you to USA for
    its business then also you will not be considered "Physically Out" of the
    Canada.
    3) If you go to USA with your earning spouse employed by "Canadian
    Business" or "Government" to live with her/him, then also same rule applys.

    But we also have members making $30K fundraising effort successful in 7 days! Hence I believe if the IV core decides to explore the possibility of a lawsuit, we can raise enough money to hire an attorney for that.

    there is a saying "if it takes 180 days for a immigrant to screw a light bulb" does not mean that "180 immigrants can screw the light bulb in 1 day".

    we have thresholds and we need more active participation. These campaigns are refreshers, we are gathering more dedicated vollunteers, we want to see more people coming forward and help us.

    30k in 7 days is a good positive way and we want to see this getting better, what I mean is

    30K in 7 days must lead to -> 100k in 20 days must lead to -500k in 2 months - if this is a pattern - then yes we can think of big things. The community must also be ready to face any failure and take it with a pinch of salt? Are we ready for it yet?

    I want the answer from the people because I do not want to sound negative :)

    Note that it would certainly not benefit the other 60%+ from countries other than India that are also stuck in various steps (EB3, name check). So, unless you want IV to stand for IndiaVoice, you should concentrate your admirable effort on increasing the overall quota (with increased per-country quota), excluding dependents, etc.

    Do not worry about that. IV has everything in the agenda what you mentioned.This thread is about 'Constitutionality argument against per-country ceilings'.Nobody here is saying to promote the fight against "Per country ceiling" ONLY.

    Yes Job market in India is lot hotter than Canada ( IT ) . For that matter it is hotter than US also !!!! But Canada is a 1st world not 3rd world. Once you get that first job in Canada and settle down, there is not much difference between US and Canada in terms of earning and saving potential. There is a short term pain for that INITIAL FIRST job in CANADA, but it is worth it.

    Do what you feel like ( moving to India vs Moving to canada) . Every place has its advanatges , In India, family is a big advantage. But quality of life especially social life really sucks! Canada, you have to consider weather ( it is COLLLLLDDDD in winter ). Do what is best for you

    Also, you mentioned that India has 50 times more jobs than Canada. It is true but the competition is also HUGE . Every teenager now a days does programming course and every second person is an enginneer.

    Nixstor: I know how responsible person you are. You must have given lot of thought to this. Even if 20-30% people buy house, that reduces the no of applicants waiting for GC which will make it faster for the people that do not want to buy now for various reasons.

    I fully support this idea. Thanks for bringing such good and justified proposal.
