This is half truth.
Tn1 to GC is legally possible but once your GC application (I140 and/or I 485) is pending, your TN1 cann't be renewed. If your dates are current, you can apply I 140 and 485 concurently and get EAD, while you hold TN1. Once you get EAD, you don't have to worry about renewal of TN. Here you need to manage possible two risks; You must get EAD before next TN renewal, and by chance, if I 485 deny, you have no back up and must return to Canada.
Current retrogression, it is not possible to go from TN1 to GC.
My PERM labor, I 140 approved and I 485 is pending since more than 12 months. I was confident and took calculative risk.

You are using labor substitution and also trying to use Part time work done by you in the college. Think yourself it is correct or not. I am sure it is the mistake of company. Many people in the forum are having 10 years of experience but waiting so long. So the the frustration is acceptable.
Labor substitution is not correct and injustice to those who are waiting for long time even if it is not sold. Legally it may be correct but this practice must be abolished. Only less than 10% of labor substitutions are genueine and others are causing delays to those who are waiting long time.Companies especially consulting companies are using every loophole in the immigration to make money. For example when there is no H1b they are bringing by L1 eventhough that position is not eligible for L1. Actually american system is Law to monitor companies and indivdual are so liberal and expected to follow Ethics. But nowadays in immigration they are trying to find every loophole in the immigration to increase the revenues of Company.

If USCIS follows Vertical Policy after EB-3 becomes current, all the remaining visas will go to EB-2 India/China and will be used up completely. With the volume of demand for EB-3 India, unless some legislative relief comes EB-3 India's problem will not be solved.
However, by following horizontal policy, if EB-2 India/China is cleared and made current, Any spillover in EB-3 should be equally shared and EB-3 India's share will improve but in miniscule way.
Fighting for legislative relief is the only way out for EB-3 instead of dividing our community between EB-2 and EB-3

This is not fair and good idea. what about people waiting in line for years and invested their money elsewhere because of this green card delays or those who do not have enough money and job in this market situation. All of the sudden you are brining this idea. This is not fair. This is kind of buying green card. There is a investment based green card category available for that. I request you to go through that channel if you are rich. Not all employment based green card seekers are rich. Please keep that in mind.

Also, IMHO, majority of indians posting here are taking it for granted that IV and the website is purely indian. It is not intentional though.

I feel that we still do not have any concrete numbers on how many of us are still waiting for the I-485 approval.
I propose we start a campaign where each member sends a letter to an IV PO Box with information that can be tracked and verified. I do not believe that a data base of anonymous unverifiable members can be presented as credible evidence to Senators, Reps, home builders associations etc. in support of our case.
Some information can be:
1. Phone number - Yes, if you are serious about this, then you better be willing to provide this information. No more anonymous BS.
2. State, County and Zip Code
3. Current Immigration Status
4. I-140 approved: Yes/No
5. I-485 pending: Yes/No
6. Number of dependents
7. Do you own a house: Yes/No
8. Will you consider buying a house if GC is approved? Yes/No
9. Profession
10. Expected 2007 year Taxes - (1) State (2) Federal
We can add more fields if needed.
Now, this information can be presented in a numerous ways, for example:
1) There are X number of applicants whose Immigrant petition has been approved, have paid $$$ in taxes, have bought houses and are actively contributing to the local community.
2) There are X number of applicants in the nation whose Immigrant petition has been approved and they are waiting for their GC to buy a house
2) There are X number of applicants in your state, who have paid $$$ in taxes, have their GC pending, and are willing to buy a house in your county when GC is approved
I understand that there are two challenges here:
1) Getting people to write to IV
2) Collecting the data. I have some thoughts on this:
- Perhaps we can have a PO Box for each region
- We can have the state leader, and a couple of others go through this information
- We could have a data base where this information can then be added. Or, just have an Excel spread sheet for each state, to start with. One could write a script to read the Excel worksheets and enter the information in a Postgres like data base.
I think data collection and organization is doable. The hard part is getting the community involved.
Any thoughts guys?

Any changes to the law have to be beneficial to all three IV constituents, i.e. EB-3 ROW, EB-2 India and EB-3 India.
This is not a legal issue. And this is not an issue of morality.
This is a political issue, and like all political issues, it involves self-interests of different groups. Those different groups have to come together, agree upon a common denominator, and work towards a common goal.
As an example, all indications are that this summer, our fate would be tied with that of CIR. Core group would be working to make sure that laws beneficial to us are passed. However, we will have to work with the illegal aliens and try to get CIR passed. Its not fair that they have been here illegally, while we have been here legally. But it doesn't matter whats fair and what is not.
What matters is that we got to work with them to achieve a common goal (CIR.) Likewise, the three constituents of this forum have to work together to achieve a common goal (relief for all.)
Lets see how long it takes before I have to reiterate this point. The clock starts now.
(a) INA 202(a)(3) states that the total number of visas available under both subsections (a) and (b) [...] exceeds the number of qualified immigrants [...] (2) shall not apply [...]. In your case, there are no excess visas available for FB immigrants.
(b) INA 202(e) Special Rules for Countries at Ceiling. requires that additional visas are distributed according to the world-wide distribution across FB and EB categories. Of the 100 unused visas 77 would have to be alloted to FB, and only 22 to EB categories. Assuming a 1/3 distribution in EB categories EB1, EB2, EB3, 7 would go to EB2.
If USCIS cannot follow this rule, those 100 visas would be unused for that fiscal year.
With AC21, the 100 can be assigned to oversubscribed countries, if Visas are available, ie. demand in all categories is less than supply. With EB3-ROW retrogressed, that is not the case.
Just the way I see it....

Hi,
1) My I-485(EB2-India) application file has two I-140 receipts (both of these are EB2) one of these I-140 is approved and the other was denied and a Motion to Reopen has been filed for this. How will the two EB2 I-140s affect my I-485 application?
2) I got a RFE for my I-1485 on June 17th 2008, asking for a I-140 approval notice. As we do not have a physical approval (never received the approval, may be lost in mail) notice my current attorney responded to the I-485 RFE and included the first I-140 receipt notice and also a copy of the approval email received from USCIS. The attorney also included the details of the second I-140 i.e the Motion to Reopen (I-290B) notice. Is the approach a good one?
3) My attorney also requested to consider the approved I-140 for adjucating the I-485 for me and my wife since the approved I-140 was filed and approved before filing the I-1485 and also we were married before the I-485 was filed. Will USCIS consider this request?
4) Also, will USCIS have a copy of my I-140 approval notice and will they use that and consider my I-485 case?
5) Will a Infopass appointment help in anyways?

I got mine approved 2 months back from countrywide with out any issues.and I got good interest rate too.
Has anybody really tried to get a mortgage recently? I have been denied by 8 lenders so far simply because I don't have a green card. Most lenders have tightened their underwriting guidelines. They will give mortgages only to U.S.Citizens or somebody who is a permanent resident aka having a green card. There are very very few lenders who will give mortgages to somebody on a visa and the rates may not be very favorable.

Further, if any one is considering to get back home, keep in mind that if you don't contribute to SSA for 10 yrs, your and your employers' contributions are simply lost (with some exceptions for countries with which US has an agreement). To collect SSA at 65 for India/China citizens you need not to be a GC holder. You can collect living in your country. If you are close to 10 yrs, just reach that mark before you make any decisions.
